Welcome to Elyside! These Terms of Service (“Terms”) govern your access to and use of the Elyside mobile application, website, and related services (together, the “Service”), operated by Elyside LLC. (“Elyside,” “we,” “our,” or “us”).

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Eligibility

To use Elyside, you must be at least 16 years old and capable of entering into a legally binding agreement. By using the Service, you represent and warrant that you meet these requirements.

2. Our Service

Elyside provides preventive health and wellness tools, including:

  • AI-driven coaching based on wearable and self-reported data
  • Integration with third-party devices (e.g., Oura Ring)
  • Biological age tracking and lifestyle insights
  • Educational content and health literacy resources
  • Optional access to certified healthcare professionals

Note: Elyside is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified healthcare provider with any questions regarding a medical condition.

3. User Accounts

To access most features, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Notify us immediately of unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal or harmful purpose
  • Upload false, misleading, or offensive content
  • Attempt to access data or systems without authorization
  • Reverse engineer or disrupt the functionality of the Service

Violation of these rules may result in suspension or termination of your account.

5. Third-Party Services

Our Service may integrate with third-party platforms (e.g., Oura, OpenAI, Supabase). Elyside is not responsible for the content or privacy practices of these external services.

You may be subject to the terms of those third parties when using their features.

6. Intellectual Property

All content and materials provided by Elyside, including software, design, text, graphics, logos, and AI-generated feedback, are our intellectual property and protected under applicable laws.

You may not reproduce, modify, or distribute any part of the Service without our prior written permission.

7. Termination

We may suspend or terminate your access at any time if:

  • You violate these Terms
  • Your actions compromise the security or integrity of the Service
  • Required by law or regulatory obligations

You may also delete your account at any time by contacting yaroslav@elyside.com.

8. Disclaimers

Our Service is provided “as is” and “as available.” We make no warranties regarding:

  • Accuracy or completeness of information
  • Health outcomes or diagnostic effectiveness
  • Uninterrupted or error-free access

Use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Elyside shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, arising out of or in connection with your use of the Service.

10. Governing Law

These Terms shall be governed by and interpreted under the laws of the jurisdiction in which Elyside Health Inc. is incorporated, without regard to conflict of law principles.

11. Changes to These Terms

We may update these Terms occasionally. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
